Purchasing rules
- General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations, liability of the Buyer and the Seller, the protection of the Buyer's data and the procedure for the Buyer to purchase goods in the e-store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts or the changed sales procedure and conditions. The Buyer is informed on the e-store website. When the Buyer makes purchases in the e-store, the Rules valid at the time of placing the order apply.
1.3. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the e-shop, specified a delivery address, selected a payment method and familiarized himself with the Seller's Rules, clicks the "Pay" button (see section 5 "Ordering goods, prices, payment procedure, terms").
- Protection and processing of personal data
2.1. The Buyer can order goods in the e-store:
- by registering or as a visitor in this e-shop – by entering the requested data;
2.2. When ordering goods, the Buyer must indicate in the relevant information fields provided by the Seller the Buyer's personal data necessary for the proper execution of the order for goods: name, surname, delivery address, telephone number and e-mail address (do not forget to indicate your e-mail address, otherwise you will not receive notifications about receipt of the order, order confirmation).
2.3. By approving these Rules, the Buyer agrees that the Buyer's personal data provided in clause 2.2. will be processed in the e-store for the sale of goods and services, for the purposes of analyzing the Seller's activities.
2.4. The Seller has the right to collect and process personal data provided by the Buyer to the Seller and, if necessary, disclose them to third parties, when and to the extent necessary for the fulfillment of the order, data processing or planning and analysis of the Seller's activities. The Seller also has the right to use the Buyer's personal data for the purposes of advertising and providing information to the Buyer within the scope of the Seller's activities. The Buyer's data may be used for sending information or for other activities of the online store only with the Buyer's consent. Approval of this legal document in accordance with the procedure established in paragraph 1.3 of the Rules also means consent to the use of personal data for the purpose established in these Rules.
2.5. By agreeing to the processing of the Buyer's personal data for the purpose of selling goods and services in the Seller's e-shop, the Buyer also agrees to the sending of information messages necessary for the fulfillment of the order for goods to the e-mail address and telephone number specified by the Buyer.
2.6. The buyer, by registering in the e-shop and ordering goods, undertakes to keep the login data safe and not to disclose it to anyone. If the buyer forgets his password, he can use the password reminder service: click on the link "Remember password" located on the main page below the login form. After entering your e-mail address, a new password will be sent to you by e-mail. If you have any questions, please contact us.
2.7. The Buyer confirms that he has had the opportunity to familiarize himself with the terms and conditions of personal data processing and has the following rights:
- to access their data and check how they are processed and to demand correction of incorrect or inaccurate personal data;
- to object to the processing of his/her personal data for direct marketing purposes;
- prohibit the collection and processing of his/her personal data at any time, except in cases where it is necessary for the fulfillment of the requirements arising from the purchase and sale agreement or for the fulfillment of the Order;
- request correction, destruction of personal data or suspension of personal data processing actions, refuse to have his/her data processed for direct marketing purposes by sending a notification by e-mail to info@boardhouse.lt or by submitting it to the Seller's registered office address, Rinktinės g. 55, 09207 Vilnius.
2.8. Data about Buyers and visitors of the online store are protected from loss, unauthorized use and alteration. Data carriers are fully protected from access by third parties. 2.9. We monitor website traffic using a statistical program and analyze the information received (number of visitors, from which pages the visitor was redirected, etc.). Statistical information is obtained automatically when visiting our website. We use this information for internal company analysis, improving the range of products and the quality of services.
2.10. On our website, we may use cookies, which are sent to the visitor's web browser when the visitor first visits our website and are stored on the computer's hard drive. Cookies are then used to facilitate the identification of your computer (the visitor) and access to information on the website. The visitor can change their browser settings to not accept cookies, as most browsers generally accept cookies.
- Buyer's rights and obligations
3.1. The Buyer has the right to purchase goods in the e-store in accordance with the procedure established in these Rules and other information sections of this e-store.
3.2. The Buyer has the right to withdraw from the contract for the purchase and sale of goods with the Seller by notifying the Seller in writing (by e-mail, indicating the desired return of the goods and their order number) no later than 14 (fourteen) days from the date of delivery of the goods.
3.3. The Buyer may exercise the right provided for in clause 3.2 of the Rules only if the goods have not been damaged or their appearance has not substantially changed, they have not been used, the labels have not been removed, and the packaging has been preserved.
3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.
3.6 The Buyer undertakes not to transfer his login details to third parties. If the Buyer loses his login details, he must immediately inform the Seller about this using the contact methods indicated at the bottom of the website.
3.7. By using the e-store, the Buyer agrees to these Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
- Seller's rights and obligations
4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the e-store.
4.2. If the Buyer attempts to undermine the stability and security of the Seller's e-store or violates its obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's ability to use the e-store or, in exceptional cases, cancel the Buyer's registration and inform the law enforcement authorities of the Republic of Lithuania.
4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information specified in the e-store registration form.
4.4. The Seller undertakes to provide the goods purchased by the Buyer in the Seller's online store.
4.5. In the event of significant and unforeseen circumstances, the Seller may temporarily or completely terminate the operations of the online store without prior notice to the Buyer.
4.6. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen non-cash payment methods, does not pay for the goods within 3 (three) business days.
4.7. The e-store has the right to withdraw from the concluded purchase and sale agreement if the stocks of the goods specified in the agreement have run out, as well as if the agreement was concluded by a person who, on the basis of the right to conclude an agreement,
- Ordering goods, prices, payment procedure
5.1. The Buyer can make purchases in the e-store 24 hours a day, 7 days a week.
5.2. The Agreement enters into force from the moment the Buyer clicks the "Pay" button, and upon receiving the order, the Seller confirms it - sends an email to the e-mail address specified by the Buyer, indicating that the order has been accepted.
5.3. If the buyer notices an error in the order or wishes to cancel the order, he must immediately contact us by phone +370(652)77855.
5.4. The prices of goods in the e-shop and in the formed order are indicated in euros, including VAT. The e-shop reserves the right to change the prices of goods in case of changes in tax rates.
5.5. The Buyer shall pay for the goods in one of the following ways:
5.5.1. The Paysera system allows you to pay for selected goods in the following ways:
By card. AB SEB bank, AB Swedbank bank, Luminor bank. AB Citadele bank, AB Šiaulių bankas, UAB Medicinos bankas, Lithuanian Credit Union electronic banking systems.
5.5.2. Pay by bank transfer to the specified current accounts of UAB "KIEK PUČIA".
5.6. If you choose the Paysera method specified in clause 5.5.1., the responsibility for data security lies with paysera.lt.
5.7. The buyer undertakes to pay for the goods immediately. If payment is not received within 3 days from the date of order confirmation, the order will be cancelled.
- Order fulfillment terms, delivery of goods
6.1. Only upon receipt of payment is the customer's order for the purchased goods formed and transferred to the Buyer's electronic account in the e-store.
6.2. In all cases, the Seller is exempted from liability for violation of the terms of delivery of goods if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control.
6.3. The Buyer must in all cases immediately inform the Seller if the Order for Goods is submitted in an inappropriate configuration, or if inappropriate or unpurchased publications are assigned to the Buyer's electronic account in the e-store.
- Product quality, guarantees
7.1. All products are covered by a 1-year quality guarantee. To find out if your product is covered by an additional free guarantee, please contact us.
7.2. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the e-store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.
- Return and exchange of goods
8.1. You can return defective goods, in accordance with the established legal acts (Article 6.22810 of the Civil Code), to our store or by sending them to us at Rinktinės g. 55, 09207 Vilnius. Before that, inform us: when the goods were purchased, what the defect is, together with the document of purchase of the goods.
We will process your refund request as soon as possible, but it may take up to 14 days.
Defective goods can be replaced with new ones, repaired, or the money paid can be refunded.
If the buyer is not satisfied with the decision or believes that his rights have been violated, the buyer may apply to the State Consumer Rights Protection Service (CC 6.2287, Art. 16, p. 1) through an extrajudicial complaint procedure, at the addresses Viniaus g. 25, Vilnius 01402, www.vvtat.lt or to the court. Before that, but no later than within 3 months after the violation, by submitting a written request to the Seller, setting out his requirements. In accordance with the procedure provided for by law, the Seller (UAB "KIEK PUČIA") will provide a reasoned, detailed written response, supported by documents, within 14 days.
The buyer has the right to fill out a request on the European online dispute resolution platform ec.europa.eu/ord/
- Buyer and seller liability
9.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not liable for the consequences arising therefrom and acquires the right to claim compensation for direct losses incurred by the Buyer.
9.2. The Buyer is responsible for the actions taken while using this e-shop.
9.3. The registered Buyer is responsible for the transfer of his/her login data to third parties. If the services provided by the e-store are used by a third party who has logged in to the e-store using the Buyer's login data, the Seller considers this person to be the Buyer.
9.4. The Seller is exempted from any liability in cases where losses arise due to the Buyer not having read these Rules, despite having been given such an opportunity, despite not having taken into account the Seller's recommendations and the Buyer's obligations.
9.5. If the Seller's e-shop contains links to the e-websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information contained there or the activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
9.6. In the event of damage, the at-fault Party shall compensate the other Party for direct losses.
- Marketing and information
10.1. The Seller may, at its discretion, initiate various promotions in the e-store.
10.2. The Seller has the right to unilaterally, without separate notice, change the terms and conditions of the promotion, as well as cancel them. Any change or cancellation of the terms and conditions and procedure of the promotion shall be effective from the moment of their execution.
10.3. The Seller sends all notifications via the means of communication specified in the Buyer's registration form.
10.4. The Buyer shall send all messages and questions to the email address specified in the Seller's e-store contact page or by calling the phone number specified there.
10.5. The Seller is not liable if the Buyer does not receive sent information or confirmation messages due to disruptions in the networks of Internet connection and email service providers.
- Final provisions
11.1 These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2 UAB "KIEK PUČIA" has the right to partially or completely change the Rules by notifying the same in the online store www.boardhouse.lt.
11.3 Additions or amendments to the Rules shall enter into force from the date of their publication, i.e. from the date on which they are posted in the online store system.
11.4 If the Buyer does not agree with the new version of the Rules, the Buyer has the right to refuse it in writing by e-mail info@boardhouse.lt or by mail to UAB "KIEK PUČIA" Rinktinės g. 55, 09207 Vilnius, provided that the Buyer does not use the services of the online store.
11.5 If, after the addition or amendment of the Rules, the Buyer continues to use the services provided by the online store, it is deemed that the Buyer agrees with the new version.
11.6 All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
